Government Job Reservation & Age Relaxation Rules in India: SC, ST, OBC-NCL, EWS, PwBD & ESM
A definitive guide to Department of Personnel & Training (DoPT) guidelines governing public sector reservations, cumulative age relaxations, the OBC ₹8 Lakh income exclusion formula, and EWS asset caps.
1. Vertical vs. Horizontal Reservation: Constitutional Framework
Reservation in appointments under the Government of India operates under Articles 16(4) and 16(6) of the Constitution:
Community Quotas (59.5%)
Mutually exclusive demographic categories: Scheduled Castes (SC) 15%, Scheduled Tribes (ST) 7.5%, Other Backward Classes (OBC-NCL) 27%, and Economically Weaker Sections (EWS) 10%. A meritorious candidate from a reserved category qualifying on unreserved standards does not consume a reserved quota slot.
Interlocking Quotas
Cuts across all vertical categories: Persons with Benchmark Disabilities (PwBD - 4%), Ex-Servicemen (ESM - 10% in Group C), and Women (where applicable by state law). A PwBD candidate is adjusted against the vertical category to which they belong.
2. DoPT Upper Age Relaxation Matrix
The standard maximum age limit specified in recruitment notifications (e.g., 27, 30, or 32 years) is relaxed for eligible categories according to DoPT regulations:
| Candidate Category | Upper Age Relaxation | Applicable Posts | Maximum Permitted Age (E.g. Base 30) |
|---|---|---|---|
| General / EWS | Nil (Base limit applies) | All Posts | 30 Years |
| OBC (Non-Creamy Layer) | +3 Years | All Central Govt Posts | 33 Years |
| SC / ST | +5 Years | All Central Govt Posts | 35 Years |
| PwBD (General / EWS) | +10 Years | Direct Recruitment | 40 Years |
| PwBD (OBC-NCL) | +13 Years (10 + 3) | Cumulative horizontal + vertical | 43 Years |
| PwBD (SC / ST) | +15 Years (10 + 5) | Cumulative horizontal + vertical | 45 Years |
| Ex-Servicemen (ESM) | Military Service + 3 Years | Group C & Group B non-gazetted | Deducted from actual age |
| Central Govt Civilian Employees | Up to 40 Years (45 for SC/ST) | Minimum 3 years regular service | 40 Years (Gen) / 45 Years (SC/ST) |

3. OBC Non-Creamy Layer (NCL) Criteria & Salary Exclusion Rule
To claim 27% reservation in central government jobs, candidates from communities listed in the Central List of OBCs must satisfy the Non-Creamy Layer test:
- ₹8 Lakh Gross Annual Income Rule: The family’s gross annual income from other sources must not exceed ₹8 Lakh for three consecutive financial years preceding the year of application.
- The Crucial Salary Exemption Rule: Many candidates are wrongly denied OBC-NCL certificates because local authorities mistakenly add parental salary. As clarified by DoPT OM No. 36012/22/93-Estt.(SCT), income from salaries and income from agricultural land are NOT included when assessing the ₹8 Lakh income threshold. Only income from business, professions, capital gains, or rental property is counted.
- Service Category Rule: Children of parents who entered as Group A / Class I officers before the age of 40 (or where both parents entered as Group B before age 40) fall under the Creamy Layer irrespective of their income.
4. Economically Weaker Section (EWS) 10% Reservation Criteria
Introduced via the 103rd Constitutional Amendment, EWS reservation applies to candidates who are not covered under the reservation scheme for SCs, STs, and OBCs:
Gross annual family income must be below ₹8 Lakh from all sources (salary, agriculture, business, profession) for the financial year prior to application.
Persons whose family owns or possesses any of the following assets are excluded from EWS regardless of income:
- 5 acres of agricultural land and above.
- Residential flat of 1,000 sq ft and above.
- Residential plot of 100 sq yards and above in notified municipalities.
- Residential plot of 200 sq yards and above in areas other than notified municipalities.
5. Competent Authorities for Certificate Issuance
UPSC, SSC, and RRB strictly mandate that community certificates must be signed by one of the following designated authorities:
- District Magistrate / Additional District Magistrate / Collector / Deputy Commissioner / Additional Deputy Commissioner / 1st Class Stipendiary Magistrate / Sub-Divisional Magistrate / Taluka Magistrate / Executive Magistrate.
- Chief Presidency Magistrate / Additional Chief Presidency Magistrate / Presidency Magistrate.
- Revenue Officer not below the rank of Tehsildar.
- Sub-Divisional Officer (SDO) of the area where the candidate and/or family normally resides.
Frequently Asked Questions (Reservation & Age Rules)
Is salary income included when determining the OBC Non-Creamy Layer ₹8 Lakh ceiling?
No. As per Department of Personnel & Training (DoPT) Office Memorandum No. 36012/22/93-Estt.(SCT) dated 08.09.1993 and clarification dated 14.10.2004, income from salaries and income from agricultural land are NOT taken into account when calculating the ₹8 lakh income limit for determining OBC Creamy Layer status.
What is the difference between Financial Year and Validity Year on an EWS Certificate?
An EWS Income & Asset Certificate is issued based on the family’s gross annual income from the previous Financial Year (e.g., FY 2025–26) and is valid for the current Financial Year / Validity Year (e.g., 2026–27). Candidates must ensure their certificate corresponds to the validity year specified in the exam notification.
Can a candidate claim both OBC-NCL and PwBD age relaxations simultaneously?
Yes. Age relaxations for horizontal categories (PwBD, Ex-Servicemen) are cumulative with vertical community relaxations. For example, a PwBD candidate belonging to OBC-NCL receives 10 years (PwBD) + 3 years (OBC) = 13 years of upper age relaxation.
Who is the minimum competent authority to issue OBC or EWS certificates?
The minimum competent authority is an officer not below the rank of Tehsildar. Certificates issued by Notary Publics, Municipal Councilors, or Gazetted Officers in their personal capacity are summarily rejected during Document Verification.
What is the age relaxation for Central Government Civilian Employees?
Central Government Civilian Employees who have rendered not less than 3 years of regular and continuous service are eligible for upper age relaxation up to 40 years of age for General/EWS candidates and up to 45 years for SC/ST candidates for Group C and non-technical Group B posts.
